So very sorry for your loss.
As other have said, there were so many red flags. First, letting a pup go before 8 weeks old, second, letting people visit so early in their life. It's way too easy for a pup to pick up a disease. A lot of breeders will share pictures but first visit to see the pups is not until 6 weeks or so.
There are laws in your state. Contact the BBB and also check into the laws covering puppy sale laws.

Thanks everyone for the condolences. Only dog lovers understand that they are more than a pet. They are family.
This puppy was to be our new love after we put our second chocolate, Rosie, down in June. Rosie was our saving angel after we put our first one down, Ruby, 13 years ago. I don't know what it's like to not have a furry, tail wagging, always happy friend to greet me when I come home, wake up in the morning, or having a furry snout to smootch on before I go to bed. . Life is definitely different without a dog. :/
The contract was discussed on our first visit. If anything happened to the puppy in the first 2 years, she would refund our money. We needed to have our vet check the puppy out within 5 days of us picking her up. We were supposed to pick her up the night before we actually did, but she couldn't get them in for their first shots until the following day. I asked (in text) if we could take her for her first shots. She informed me that this would void her contract. Add another speed bump.....we never got a written contract, but I do have all of our texts that mention the contract. I don't know if they would hold up in court or not.
I don't want to be a jerk, but I paid for a puppy. I'm out $1200 after all is said and done. That's just not fair, and I wouldn't hesitate to return the money for the puppy if I were the breeder. I would feel awful. When she offered to refund my money, I was sitting in the vets office trying to figure out what to do. I didn't want her to come here and risk bringing it back to the remaining pups. That's why I said to wait. She did mention that she let them go too early, but I'm trying to be positive and think that if we waited, all the other pups might have been infected. That would have been devastating to lose the whole litter. And if I gave the puppy back, that might have brought the virus back to the rest of the litter as well.
Its just a sad situation all around. What makes it worse for us is knowing that we have to wait to find a new love. We have bleached everything that can be bleached, tossed everything that couldn't be bleached, and will continue to do so to make sure this isn't spread unknowingly to any other dogs. The neighbors won't even wave at us anymore. It's like we have the plague. Ugh.
Thanks for listening. I tend to babble, so I apologize. Give all your furry babies a smootch on the snout for me, for Rosie, and our puppy that we wish was here with us today. .

As others have already mentioned here...there are a lot of red flags concerning this breeder...
Do you know why the mother died after giving birth? I wonder how old the mother was?
The other big red flag I see here is that this breeder let people visit her puppies when they were very young...big red flag!
No reputable breeder will allow any visitors when the puppies are so young...this is a very easy way for the pups to contact Parvo..
And of course..letting the pups go at only 6 weeks of age..

I'm so sorry for the sadness you're having to go through with all of this. Barring all of the red flags, it does sound like the breeder was willing to work this out with you at one point. I would politely ask for a refund of the puppy purchase price - and if you've been less than polite, back up a bit and try to smoothly transition back to a reasonable solution with the breeder. Things get heated during times like these, and it would be understandable if you were expressing some anxiety and exasperation. Keep it short and sweet, and see what happens. Good luck with all of it...
I've been nothing but patient. I understand the heartache that is going on in her life, losing the mother of her puppies that she very much loved. There are family health issues that she is dealing with as well. That's why I'm trying to be patient. I'm not being pushy. I am trying to be compassionate to what's going on in her life because I know she has been hit hard with many things at once. We all experience this at some point in our lives, and it all seems to come at once. Been there, done that, as I'm sure most of you have at some point.
This is was to be the mothers 3rd and final litter. I'm not sure of her age (would have to pull the pedigree). The death was due to her "bleeding out" after some procedure after the pups were born. 2 were stuck in the birth canal and didn't survive. I'm not a breeder, and will never be, so I'm not sure what procedure was done, and whether it was done correctly or incorrectly. The breeder did offer us the last puppy from the litter, but I just couldn't, in good conscience, bring another puppy in right now. Even though I've taken extreme measures to disinfect, I'm just not ready to take that chance. Our puppy was only here for a short time, but I need to be sure it's safe to try again.
I don't know of any laws in michigan that state the age of which a puppy can be sold. I'm sure our Rosie was 7 weeks old when we picked her up 13 years ago. I don't recall how old she was when we first went to visit and pick her out. I had second thoughts because I thought I was getting another friend too soon after Ruby. I'm so glad my family convinced me that it was ok. She was just what we needed at that time, and we had many happy memories with her for the next 12+ years.
We will try again in the future, and hopefully things will be different. It's going to be a long winter.

Though I agree there are many red flags with your breeder, it seems like they are doing the right thing by offering to return your money and offering a replacement puppy.
You should have gotten a written contract. I would ask her for a copy. Did you sign it together when you picked the puppy up?
