    Ticket suggestions?

    My husband is driving through New York. There was a huge accident right across the border on the interstate. Everyone was told to turn around because there was no shoulder at the site of the accident. He did along with about 40 others. Not long afterward, the entire line was stopped by another state trooper who had an altercation with one of the drivers in the line, all of their licenses and registrations were taken and they were directed to a rest stop where they were all given tickets by yet another state trooper who was very nice and almost conciliatory. He acted like he couldn't do anything about it but had to do his job.

    The ticket has a section on it for an explanation of why he was going the wrong way on the interstate (the breakdown lane).

    Any thoughts on this? He doesn't have the name of the trooper who was directing traffic on the end of the accident. The trooper who gave him the ticket described it as really bad and kind of used the encounter as a therapy session. He was clearly unnerved.

    I get that this was an awful situation for the officers but there was clearly a failure of communication on their part. What's the best way to handle this? One woman said that she wasn't going to contest it because she didn't have the time so clearly some will just pay it. I'm concerned about insurance though.

    Thoughts?

    Id contest the ticket. Time date highway and that that they were ordered to turn around by a police officer if 40 people got tickets for the same reason thats a problem. I would have totally lost my cool in a situation like that. Were the tickets written by New York s well or did he cross back into the others state? Those tickets should be thrown out. They will be able to search for the accident report.

    The media haven't got hold of that? Coverage in the media should bring the officer's conduct to light. My thinking is he should pay but hope media coverage results in a rebate, in, oh, about ten years. What does your insurance say?

    We found an attorney and have a consult scheduled for tomorrow. Thanks for triggering me to think about these things. It's been 30 years since his last (and only) one so we weren't sure what to do.

    In our news a rash of drivers are getting slammed with decades old tickets they never paid. Some have had their driver's licenses suspended. The advice being given out, now, is pay it or fight it. Don't just ignore it.

    Absolutely fight it. Here in MA the points on your insurance add up quick. I believe a moving violation is 2 points for 6 or 7 years. I had a minor accident (single car) and they charged me with points. I had printed out all sorts of info on the storm that had occurred that day and was all prepared for a grilling. The magistrate told me, "everyone here today had an accident the same day as you. I know what the conditions were like. Did you hurt anyone or damage anyone's property?" I said No and the case was dismissed.

    Fight it. My husband blew some tolls on the way home from down south because the toll booths were on the left side of the highway and he could not get over in those lanes safely. He just wrote a check for the toll amount and wrote a letter explaining to why the toll was not paid and that he had no intention of not paying it and they sent back a receipt a week or so later saying it was taken car of. Fight it, he did what the officer told him to do, I would contact the dept of the officer that instructed him to drive on the break down lane the wrong way, explaining that 40 other cars also followed his orders, ask for their assistance.
